CROP Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") govern your use of CROP, a mobile application provided by Vela Studio ("Vela Studio," "we," "us," or "our").

By downloading, accessing, purchasing through, or using CROP, you agree to these Terms.

If you do not agree to these Terms, you should not use CROP.

2. About CROP

CROP is a fitness journey photo application that allows users to create, edit, organize, export, and preserve fitness-related photos and records.

Features may include photo editing, workout labels, dates, manually entered locations, Gallery functionality, fitness journey information, and training-day tracking.

Features may be added, modified, restricted, or removed over time.

3. Eligibility

You must be legally permitted to use CROP and to enter into these Terms under the laws applicable to you.

If you are not legally able to enter into these Terms independently, you may use CROP only with any consent required by applicable law.

4. Free Features

CROP may provide certain features without a paid subscription.

Free functionality, limitations, usage allowances, and available features may change as CROP develops.

Some content or functionality may be limited or locked unless CROP PRO is active.

5. CROP PRO

CROP may offer an optional paid subscription called CROP PRO.

CROP PRO may provide access to additional functionality, expanded usage limits, premium features, or other benefits identified within the app at the time of purchase.

The exact features included in CROP PRO may change over time.

6. Subscription Plans

CROP PRO may be offered through subscription plans including monthly and yearly subscriptions.

Available plans, prices, currencies, promotional offers, and subscription periods may vary by country, region, account, or App Store configuration.

The price and billing period displayed by Apple at the time you confirm your purchase will apply to that transaction.

7. Billing and Automatic Renewal

CROP PRO subscriptions purchased through the iOS application are processed through Apple's In-App Purchase system.

Payment will be charged to the Apple Account associated with your App Store purchase after you confirm the transaction.

Unless canceled, an auto-renewable subscription will renew automatically in accordance with the subscription terms shown by Apple at the time of purchase.

Renewal charges and applicable prices are determined through Apple's subscription system.

8. Managing or Canceling a Subscription

You can manage or cancel your CROP PRO subscription through your Apple Account subscription settings.

Deleting CROP from your device does not automatically cancel an active subscription.

Cancellation generally prevents future renewal and does not necessarily terminate access immediately. Access may continue until the end of the applicable paid subscription period, subject to Apple's policies.

9. Refunds

Purchases made through Apple's In-App Purchase system are subject to Apple's payment and refund policies.

Vela Studio does not independently process App Store payment card transactions and may not be able to issue refunds directly for purchases processed by Apple.

10. Restore Purchases

CROP may provide functionality that allows eligible previous purchases or subscription entitlements to be restored.

Restoration depends on information provided through Apple and the subscription services used by CROP.

11. RevenueCat

CROP uses RevenueCat to assist with subscription management, purchase validation, entitlement status, and purchase restoration.

Use of CROP PRO therefore involves communication with Apple and RevenueCat as necessary to provide subscription functionality.

12. Photos and User Content

CROP may allow you to select photos, capture photos, enter text, create workout labels, add dates or locations, and create other content ("User Content").

You retain your rights in User Content you create or provide, subject to any rights belonging to third parties.

You are responsible for ensuring that you have the necessary rights and permissions to use any photo, text, image, trademark, or other material you use with CROP.

13. Prohibited Content and Conduct

You agree not to use CROP to:

• Violate applicable laws or regulations
• Infringe intellectual property or privacy rights
• Use content without necessary authorization
• Attempt to interfere with or compromise CROP
• Attempt to bypass subscription or feature restrictions
• Reverse engineer CROP except where expressly permitted by law
• Use CROP for fraudulent or abusive purposes
• Introduce malicious software or harmful code

14. Photo Storage and Data Loss

Certain CROP content may be stored locally on your device.

You are responsible for maintaining copies or backups of photos or other content that are important to you.

Removing CROP, deleting app data, losing or replacing a device, software errors, operating system behavior, or other circumstances may result in loss of locally stored content.

To the extent permitted by law, Vela Studio is not responsible for loss of locally stored User Content where such loss is outside our reasonable control.

15. Export and Training-Day Records

CROP may record an eligible training day when an image is successfully exported.

Multiple exports on the same calendar day may be treated as a single training day.

Training-day counts and related features are intended as organizational and motivational tools and should not be treated as authoritative health or fitness records.

16. Fitness and Health Disclaimer

CROP is a photo, organization, and fitness journey application. It is not a medical or healthcare service.

CROP does not provide medical diagnoses, medical treatment, professional fitness advice, or healthcare advice.

Information displayed or recorded within CROP should not be used as a substitute for advice from qualified healthcare professionals.

17. Intellectual Property

CROP, including its software, design, interface, branding, logos, graphics, text, features, and other materials provided by Vela Studio, is owned by or licensed to Vela Studio and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of CROP or Vela Studio intellectual property to you.

18. License to Use CROP

Subject to these Terms, Vela Studio grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use CROP for its intended purposes on devices you own or control, subject to applicable App Store rules.

19. Availability and Changes

We may update, modify, suspend, discontinue, or change features of CROP where reasonably necessary.

We do not guarantee that every feature will remain available indefinitely or that CROP will operate without interruptions or errors.

20. Updates

CROP may receive updates that modify functionality, design, compatibility, security, or technical requirements.

Some features may require installation of a current version of CROP or a supported version of iOS.

21. Third-Party Services

CROP may rely on third-party services, including Apple and RevenueCat, to provide certain functionality.

Third-party services are governed by their own terms, policies, availability, and technical systems.

Vela Studio is not responsible for third-party services to the extent such matters are outside our reasonable control.

22. Disclaimer of Warranties

To the maximum extent permitted by applicable law, CROP is provided on an "as is" and "as available" basis.

We do not guarantee that CROP will always be uninterrupted, error-free, secure, or compatible with every device, operating system version, or third-party service.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded under applicable consumer law.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Vela Studio will not be liable for indirect, incidental, special, consequential, or similar losses arising from your use of or inability to use CROP.

This includes, where legally permitted, loss of locally stored content, loss resulting from device failure, or interruptions caused by third-party services.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

24. Suspension or Termination

We may restrict or terminate access to CROP where reasonably necessary if you materially violate these Terms, misuse the service, interfere with its operation, or where required by law.

You may stop using CROP at any time.

25. Privacy

Your use of CROP is also subject to the CROP Privacy Policy, which explains how information is handled when you use the app.

26. Apple App Store Terms

If you download CROP through Apple's App Store, your use of CROP is also subject to applicable Apple Media Services Terms and App Store requirements.

Where Apple's applicable terms impose requirements that apply to CROP or your use of it, those requirements also apply.

27. Changes to These Terms

We may update these Terms to reflect changes to CROP, our business practices, legal requirements, platform requirements, or other relevant circumstances.

The "Last Updated" date at the top of this page identifies the latest revision.

Where required by applicable law, we will provide appropriate notice of material changes.

28. Governing Law

These Terms are governed by applicable law, subject to any mandatory consumer protection rights or other legal rights that apply in your place of residence and cannot lawfully be excluded by agreement.

29. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
